Iron Bay Equipment

Do I need insurance to rent a Smartlift?

It comes in two parts. If you rent for a business, send a general liability certificate before delivery. For damage to the machine itself, there are two ways. Take the damage waiver, which is its own line on the quote. Or send a certificate for rented equipment coverage that names Iron Bay Equipment LLC as loss payee. If you rent for yourself and not a business, the damage waiver is required.

What to send before delivery.

We ask for certificates when you book, so nothing holds up the truck.

  1. A liability certificate

Business renters send a commercial general liability certificate. It names Iron Bay Equipment LLC as additional insured, on a primary and noncontributory basis, with a waiver of subrogation in our favor. Add workers' comp as Florida law requires. Your agent will know those terms. The rental agreement and your quote set the minimum limits.

  2. Cover for the machine

Either the damage waiver, or a certificate for inland marine or rented equipment coverage that names Iron Bay Equipment LLC as loss payee. The agreement and your quote set the amount it has to cover.

  3. Why general liability is not enough

The rental agreement does not accept a general liability certificate for the machine, even with Iron Bay named as additional insured. Most general liability policies leave out equipment you rent anyway.

  4. If a certificate is late

If the machine certificate is not in by delivery, the damage waiver is added and charged. If the liability certificate is missing, or your quote shows the waiver as not available, delivery can wait until the certificate arrives. You can also cancel under the agreement's cancellation terms.

What the damage waiver does.

It limits what you pay if the machine is damaged by accident or stolen during the rental. It is not insurance.

  • Accidental damage or theftYou pay up to the deductible on your agreement for each occurrence, and we waive the rest. We never bill parts or labor on top of the deductible for a covered occurrence.
  • The machine onlyIt does not cover the glass or stone you lift, the property at the job site, or anyone who gets hurt. The risk to your material and the site is yours under the rental agreement, so ask your agent what covers it.
  • Our insurance is not yoursIron Bay's insurance protects Iron Bay only. Your coverage comes first and stays in force until we have the machine back. A certificate does not cap what you owe if the machine is damaged.
  • Its own lineThe waiver is never bundled into the rate, so you see exactly what it costs before you book.

What the waiver does not cover.

The main ones, from Section 12 of the rental agreement. The full list is there.

  • Any prohibited useAnything Section 7 of the agreement bans. Going past the load chart is one, including the lower limit at full reach, in wind, or on an attachment. Lifting a wet or dirty face, working in the rain, and working on a slope steeper than the manual allows are others.
  • An open siteTheft while nobody from your crew is on site and the machine is not locked indoors with the key and remote out. A fenced yard does not count.
  • An unreported theftTheft that is not reported to the police within 48 hours, with a copy of the report sent to us.
  • Missing, no reportThe machine or a part goes missing and no theft was reported.
  • Your own peopleTheft or a failure to return it by you, your crew, or anyone you let use it.
  • Rain and floodRain or rising water getting into the machine. At the end of each day and whenever your crew leaves the site, it goes inside a locked building or container with the key and remote out.
  • Moving it yourselfTrailering it or taking it off the job site. Only Iron Bay transports the machine.
  • Late daysDamage after the expected return date, unless we approved the extension in writing or the machine was ready and waiting for our pickup.
  • Fees still applyWith the waiver you still pay the cleaning, idle, failed-trip, late-return and payment charges in full.

The follow-ups.

The five questions that usually come right after this one.

Is the damage waiver insurance?

No. It is our agreement to limit what we collect from you if the machine is damaged by accident or stolen during the rental. It covers the machine only, not the material you lift, the job site, or injuries.

Can I decline the damage waiver?

Business renters can, by sending a certificate for inland marine or rented equipment coverage that names Iron Bay Equipment LLC as loss payee, before delivery. If you rent for yourself and not a business, the waiver is required, and you confirm you carry personal liability coverage. We may ask for proof. If your quote shows the waiver as not available, that rental is for business renters only.

Does my general liability policy cover the machine?

The rental agreement does not accept it for the machine, even with Iron Bay named as additional insured. Most general liability policies leave out equipment you rent anyway. You need rented or leased equipment coverage, often called inland marine, or the damage waiver.

What if my certificate does not arrive in time?

If the machine certificate is not in by delivery, the damage waiver is added and charged. If the liability certificate is missing, or your quote shows the waiver as not available, delivery can wait until the certificate arrives. You can also cancel under the agreement's cancellation terms.

How much is the damage waiver?

It is shown as its own line on your quote, worked out from the rental charges. Send the zip and your dates. We answer within two hours, 9 to 5, seven days, and quote as soon as we have your job details.
